Privacy – Informativa sul trattamento dei dati personali

The website www.studiopagani.it (hereinafter the “Site”) is owned by Studio Associato Pagani and the company Studio Pagani Payroll S.r.l. (collectively the “Studio Pagani” or “Joint Controllers of processing”), and the security measures applied to this Site have been developed to ensure that user-provided information (hereinafter “Users” or “User”) is processed in compliance with applicable data protection and privacy regulations, for the purposes and in the ways further described in this notice (hereinafter “Privacy Policy”).

The Privacy Policy is provided pursuant to Article 13 of the European General Data Protection Regulation (“GDPR”) and Article 13 of Italian Legislative Decree 196/2003 (the “Privacy Code”) and aims to describe how this Site is managed regarding personal data processing of users who browse it, as well as to allow users to understand the purposes and methods of personal data processing by Studio Pagani when data is provided.

This Privacy Policy is also inspired by Recommendation No. 2/2001 on minimum requirements for online data collection in the European Union, adopted on 17 May 2001 by the Article 29 Working Party. The Policy applies only to this Site and not to other websites the User may visit through links on this Site.

Studio Pagani declares that it has not carried out any verification of third-party sites, and therefore assumes no responsibility or offers any guarantee concerning their privacy practices. The Privacy Policy is easily consultable from the home page and via links from every page of the Site.

1. Data Controllers
The data controllers are Studio Associato Pagani, represented by its current legal representative, with registered office at Viale Tunisia, 27 – 20124 Milan, and Studio Pagani Payroll S.r.l., represented by its current legal representative, with registered office at the same address (collectively “Joint Controllers,” separately “Controller”).
The Joint Controllers have, by internal agreement, determined their respective responsibilities in relation to compliance with data protection obligations, especially concerning their roles and relationships vis-à-vis data subjects. The User may contact the Controllers via email at privacy@studiopagani.com or by mail at Viale Tunisia 27 – 20124 MILANO.

2. Data Processors and Authorized Persons
The processing connected to the web services of this Site takes place at the Controller’s registered office and may be conducted by internal or external Data Processors, duly appointed pursuant to Article 28 GDPR, as well as by persons authorized to carry out processing operations, appointed pursuant to Article 29 GDPR.

3. Personal Data Subject to Processing

For “personal data” we mean any information relating to an identified or identifiable natural person, particularly by reference to identifiers such as name, identification number, location data, or online identifiers. The personal data collected by the Site are:

3.1 Navigation Data
The IT systems and software procedures supporting this Site acquire, during normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols. These are data not collected to be associated with identified users, but which by their nature could, through processing and association with data held by third parties, allow user identification.
This includes IP addresses or domain names of user devices, URI addresses (Uniform Resource Identifier) of requested resources, request timestamps, the method used to submit the request to the server, file size obtained in response, numerical codes indicating server response status (success, error, etc.), and other system parameters concerning the user’s operating environment. These data are used only to derive anonymous statistical information on site usage, without possibility of identifying the User, and are aimed at measuring Site functionality and operational features, including troubleshooting.
These data are deleted immediately after processing. They may also be used for investigating responsibility in alleged computer crimes against the Site. This processing is based on the legitimate interest of the Joint Controllers.

3.2 Data Voluntarily Provided by the User
This includes personal data freely provided by the User on the Site, for example: contact data when sending emails to site addresses, any other personal data included in communications sent by email; data provided when submitting a CV (curriculum vitae) and other information relevant for personnel selection; data provided when registering or accessing reserved areas, requesting newsletters or information about a product or service via form.
Each User can modify their data by sending an email to privacy@studiopagani.com, specifying in the subject line “Exercise of personal data protection rights.” Summary information will progressively be included or displayed on pages dedicated to specific services on the Site.

4. Purposes and Lawful Basis of Processingi
Except for navigation data described in 3.1, as referred, personal data provided by Users via the Site are processed for the following purposes under the respective lawful bases:

  1. To carry out actions strictly connected and instrumental to managing relations with Users, such as responding to contact requests, answering questions via contact forms, enabling reserved sections (if any), managing CV submissions for personnel selection, and other relevant user information. The lawful basis is the performance of a service or response to a user request.
  2. To comply with legal obligations applicable to data controllers under laws, regulations, or EU directives. The lawful basis is compliance with legal obligations.
  3. To ascertain, exercise or defend a legal claim in courts, whenever judicial authorities exercise their functions. The lawful basis is the pursuit of the legitimate interest of the Controllers.
  4. To carry out information, promotional, commercial, and marketing activities about additional services of the Controllers. This processing is based on the explicit consent of the User, obtained via suitable summary information on pages dedicated to requested services.
  5. The User may revoke consent at any time, without affecting the lawfulness of processing based on consent before revocation.
  6. To perform maintenance and operation of the Site, including resolving technical issues. In general, this does not involve processing personal data, but when it does, the lawful basis is the legitimate interest of the Controllers.

6. Nature of Data Provision and Consequences of Refusal
Except as specified in 3.1 regarding navigation data collected automatically by the system and regarding the operation of cookies (for which the relevant cookie notice applies), the User is free to provide or withhold their personal data.
Registration as a User of the Site is free and requires filling out a form providing certain personal data. Providing these data is optional; however, failure to provide, or providing incomplete or incorrect data, prevents the provision of the service. Use of passwords, IDs, or special access keys on this Site is the User’s responsibility.

7. Processing Methods and Retention Periods
User data will be processed with or without electronic or automated means for the time strictly necessary for the purposes for which the data are collected and processed, and, in any event, within the periods required by the Privacy Code, GDPR, and currently applicable regulations.

8. Scope of Disclosure and Dissemination
For the purposes outlined above, personal data provided will be processed only by persons appointed by the Controllers, such as employees, collaborators, internal and external consultants, designated Responsible or Authorized Processors, and given specific instructions.
User personal data may also be disclosed or transferred to parties legally permitted to access such data under law, regulation, or orders from legitimate authorities.

9. Rights of the Data Subject
As per Article 13 of the GDPR, the User may at any time:

  1. Request from each Controller access to personal data, correction, deletion, or restriction of processing;
  2. Object to processing;
  3. Exercise the right to data portability;
  4. Revoke consent at any time without affecting the lawfulness of processing before revocation;
  5. Lodge a complaint with a supervisory authority.

Additionally, at any time, the User may exercise rights under Article 7 of the Italian Privacy Code, including confirming whether personal data concerning them exist, obtaining their origin, processing purposes, methods, logic used, the identity of Controllers, Processors, or categories of parties who may receive data; obtaining update, correction, integration; deletion, anonymization, or blocking; and more.

10. Updates
The Joint Controllers reserve the right to modify, at any time and due to changes in applicable law, this Privacy Policy by updating this page. The User is therefore asked to periodically review this page to learn of updates.

Comments and Suggestions

Studio Associato Pagani and Studio Pagani Payroll S.r.l. do not wish to receive personal, confidential, proprietary, or sensitive information via this site or any postal/electronic address. Users are not authorized to use the site or any email addresses to send such information.
Comments and suggestions are not personal data: non-personal content, including comments, suggestions, ideas, or questions, are considered non-confidential. Studio Associato Pagani and Studio Pagani Payroll S.r.l. are free to use or disclose such data for any purpose without obligation to the provider. They may reproduce, use, publish, display, transform, or distribute comments and suggestions, or create derivative works, or disclose them to third parties without limitation.
