Abstract

Employee Dismissal for a Defamatory Facebook Post: Privacy as a Limit on Digital Evidence

A defamatory Facebook post can justify an employee’s dismissal, as it violates loyalty and fairness toward the employer. However, the Court of Cassation stresses that privacy remains a fundamental limit: any evidence obtained in ways that breach the confidentiality of communications cannot be used in court. This ruling highlights the ongoing balance between freedom of expression and workplace responsibility in the digital age, especially when dealing with digital evidence and online behavior. Employers and employees alike must understand the legal boundaries to navigate social media use at work responsibly.
